Can I Stop My Divorce?

For one reason or another, one spouse or both partners may wish to delay or stop the divorce process. Depending on the circumstances involved, there may be certain situations where this is possible. Situations where you can stop your divorce proceedings include:

  1. You Are the Petitioner – If you filed the Petition for Divorce and your spouse did not file a Counterpetition, you can file a Motion to Nonsuit your divorce and dismiss the suit; or
  2. Both Spouses Agree – If you are not the Petitioner or if your spouse filed a Counterpetition in response to your divorce action, but you both agree to stop the divorce proceedings, you may file a Motion to Nonsuit and ask that the court dismiss the divorce suit.

Please note that Texas is a no-fault divorce state, meaning that the divorce can be finalized even if only one spouse wants to proceed with the divorce.
