Benefits of Uncontested Divorce

Posted By Menduni Martindill, PLLC || 10-Dec-2014

An uncontested divorce is what happens when both spouses agree to the divorce and do not have serious issues with how spousal maintenance, child custody, and property division will be awarded. A contested divorce is one where the spouses cannot reach an agreement about anything in a divorce. Contested divorce can take months of expensive litigation to come to a close. In contrast, obtaining an uncontested divorce allows a couple to avoid any major court hearings and resolve the split in less time.

Should I choose an uncontested divorce?

If a couple agrees on their decision to divorce one another, uncontested divorce may be an available choice. Along with this general agreement, there cannot be significant concerns about spousal support, property division, and child custody and visitation. A judge will use a streamlined method in order to resolve the divorce. When any of this is not agreed upon by a spouse, the divorce must be seen as contested and held to contested divorce proceedings.

There are a few reasons why choosing an uncontested divorce may be the best option:

  • Less time and paperwork to be filed
  • Reduced need for a court hearing
  • Lowered attorney fees and court costs
  • More information kept private
  • Less correspondence between parties

However, an uncontested divorce cannot be for everyone. Those that may need to dispute any portion of their property or maintenance in the process would be better suited for a contested divorce. Divorce is a complicated and tricky matter that involves digging deep into a person's life. If spouses are not able to go into the process with collaborative understanding, then an uncontested divorce will not work.

No matter what option for divorce someone chooses, it is important that they are represented by lawyers that will fight for what is in their best interests.
